General

THE GENERAL BODY

a) A meeting legally convened of all members constituting the Supreme Executive, all members of the Constituency Working Committees and the Village Representatives shall constitute the General Body of the Party.
b) The General Body Meeting shall be convened at least ONCE in a calendar year, and shall be chaired by the Party President or, in his absence, by one of the two Vice Presidents, preference being given to the Vice President senior in age.
c) The General Secretary shall give notice to each member of the General Body TWENTY ONE days in advance of the meeting. Such notice shall include the agenda, date, time and venue of the meeting.
d) The quorum for the General Body Meeting shall be 1/4th the total number of members who constitute the General Body. In case there is no quorum, the meeting shall be adjourned for one half hour and re-convened at the end of the said period as if the quorum is complete. All decisions taken by the reconvened meeting shall be valid proceedings.
e) All resolutions shall be passed by a simple majority of the members present and voting. A resolution passed at the General Body meeting shall be binding upon the Supreme Executive. However, no resolution shall be moved by any member(s) unless the nature and the contents of such resolution alongwith the names of the proposer and of the seconder and reasons for moving such resolution have been first communicated in writing to the General Secretary at least FIFTEEN days in advance of the date of the General Body meeting. Any proposed resolution that militates against the aims and objectives of the Party and its Constitution shall not be allowed to be moved.
f) EXTRA-ORDINARY GENERAL BODY MEETING:
An Extra-Ordinary General Body meeting may be called for by the Party President or it may be requisitioned by Party member/s by an application to the Party President stating the reason for calling for such a meeting. Such an application shall be signed by not less than 1/4th of the total number of members constituting the General Body. The Party President shall call for the Extra-Ordinary General Body meeting within TWENTYONE days from the date of receipt of such an application and the General Secretary shall send appropriate notice at least TEN days in advance to all the members of the General Body. All resolutions shall be passed by 2/3rd. majority vote of the members present and voting. In the absence of the quorum at the appointed time, the said meeting shall stand cancelled and no meeting may be called for, once again, on the same grounds for the next twelve months.

  1. PARTY CONVENTION:
    The Party Convention is a meeting of all the members of the Party convened at least once in TWO years at a place to be decided by the Supreme Executive for the purpose of providing the ordinary member an opportunity to express his/her views in a larger forum, to meet the entire Party Organization, and to move resolutions which have been previously communicated to the Party Executive. Such resolutions, if passed by a simple majority, will be of a recommendatory nature only.

  1. RESIGNATION:
    a) Any member of the Party who wishes to resign from any post at any level including any Party Executive post, shall do so by handing in his/her resignation letter to the Secretary of the respective District or to the General Secretary. The resignation shall be deemed to have been accepted on the expiry of TEN days from the date of handing-in the resignation. However, such resignation shall not affect his/her membership of the Party. The vacant post shall be filled within THIRTY days of the resignation coming into effect.
    b) Any member of the Party who wishes to resign from the Ordinary membership of the Party shall do so by handing in his/her resignation letter to the Secretary of the respective CWC or to the General Secretary. The resignation shall be deemed to have been accepted on the expiry of TEN days from the date of handing in of the resignation. Any person who has resigned from the Party membership or whose membership has been terminated shall return all Party effects including Party documents and identity card to the Party office in his/her area or to the Head Office, and shall be ineligible to apply for the Party membership again.

  1. EXPULSION /SUSPENSION FROM PARTY MEMBERSHIP:
    The Disciplinary Committee constituted by the Supreme Executive shall have the power to suspend or terminate the membership of any *** member from the Party membership and/or from any Party post at any organizational level including the Party Executive on the following grounds:
    a) Non attendance of FIVE consecutive meetings without justification.
    b) For any activity deemed detrimental to the progress of the Party and also to its aims & objectives.
    c) Willful disobedience of the express directives or orders of the Supreme Executive.
    d) Defections by elected representatives in the Legislature.

Provided that such member shall, on being so suspended and before his membership or his Party post terminated, be given an opportunity by way of a show cause notice issued by the Disciplinary Committee to answer the charges leveled against him/her. An appeal against the decision by the disciplinary committee maybe made to the Supreme Executive through the Party President in writing within THIRTY days of receiving communication of the decision of the Disciplinary Committee.

Such appeal shall be decided by a simple majority of the Supreme Executive within THIRTY days the of filing of the appeal. After hearing the appellant, the Supreme Executive may enhance or reduce the period of suspension, and in case of termination, it may enforce, set aside or suspend the member from the Party or from the post for such period as it deems fit. Any such decision shall be final and shall be communicated to the member in writing.
